NOTICE ABOUT DISPUTE RESOLUTION: This Messaging Policy contains an arbitration clause and a class action waiver (see Section 16), which outline how disputes between you and Hashtag Management UK Limited (referred to as "Hashtagluck," "we," or "us") will be handled. By using our Messaging Services, you agree that any disputes will be resolved through individual arbitration, and you waive the right to pursue claims in court or take part in a class action lawsuit.

1. SCOPE OF APPLICATION
This policy governs how you use Hashtagluck's text messaging services (referred to as "Messaging Services"), which includes all messages sent to your mobile device. By using the Messaging Services, you agree to comply with this policy.

Note: Your interactions with Hashtagluck's website, located at www.hashtagluck.com, its applications, or social media pages, are governed by separate terms. If you participate in any of our prize draws, please ensure you understand the specific rules related to those draws.


2. ACCEPTANCE OF THIS POLICY
By subscribing to our Messaging Services, you agree to receive recurring promotional and personalized text messages from Hashtagluck or its service providers, possibly through automated systems. Standard messaging and data rates apply. Subscribing is optional and is not required for purchasing any products or services. If you change your mobile number, you must re-enroll with your new number. If you disagree with this policy, do not sign up for, access, or use the Messaging Services.


3. POLICY UPDATES

We reserve the right to update this policy at any time. Any changes will become effective upon posting. Your continued use of the Messaging Services after an update means you accept the revised policy. Please check this page regularly for updates.

13. DISCLAIMER OF WARRANTIES
The Messaging Services are provided "as is," without warranties of any kind. We do not guarantee the uninterrupted operation of the services, nor do we warrant the accuracy or reliability of the content provided. Use of these services is at your own risk.

 

14. RESPONSIBILITY FOR DAMAGES
You may be held liable for any damages caused to Hashtagluck or its affiliates as a result of violating this policy.

 

15. LIMITATION OF LIABILITY
Hashtagluck will not be liable for any indirect or incidental damages arising from the use or inability to use the Messaging Services. Our total liability is capped at £100.

 

16. DISPUTE RESOLUTION
Any disputes related to this Messaging Policy or the Messaging Services must be resolved through binding arbitration on an individual basis. Class action lawsuits are not permitted. You and Hashtagluck agree to resolve disputes individually.


17. JURISDICTION AND GOVERNING LAW
This Messaging Policy, and any disputes arising from it, are governed by the laws of England and Wales. If arbitration does not apply, legal proceedings may be brought in the English courts or in your local courts in the UK.

 

18. TIME LIMIT TO FILE CLAIMS
Any claim related to this policy or the Messaging Services must be filed within one year of the cause of action arising.

 

19. GENERAL TERMS

  • Relationship: This policy does not create a partnership or joint venture between you and Hashtagluck.
  • Assignment: Hashtagluck may transfer its rights under this policy without your consent. You cannot transfer your rights without our permission.

  • Force Majeure: Neither party is responsible for failures or delays caused by events beyond their control, such as natural disasters or technological disruptions.
  • Severability: If any part of this policy is found unenforceable, the remaining provisions will continue to apply.
  • Entire Agreement: This Messaging Policy represents the full agreement regarding the Messaging Services between you and Hashtagluck.
